천일국 법정신과 법적용에 관한 연구 : 원상의 구조를 중심으로
본 논문은 천일국 천법원의 법관이 일체의 쟁송을 천일국법을 기준으로 해석하 고 적용함에 있어, 그 해석의 기준이 되어야 할 천일국의 ‘법정신’이 무엇이어야 하 는지를 아르투어 카우프만(Arthur Kaufmann)의 ‘법해석학’을 중심으로 고찰하여 그 시사점을 발견한다. 이를 토대로 천일국의 ‘법정신’을 통일사상요강 ‘원상의 구조’ 를 중심으로 비교하여, 천일국의 ‘법적용’의 원칙을 제시한다. 본 연구는 천일국 천 법원의 법관들이 ‘천일국의 법정신과 법적용’에 대한 명확한 이해를 기반으로 하여, 천일국에서 발생하는 일체의 쟁송심판의 결과가 ‘투쟁과 분열’이 아닌 ‘조화와 화합’ 을 지향하며 천일국의 정착과 안착에 더욱 기여할 수 있는 가능성의 단초를 제공한 다. 이를 위해 천법원이 어떻게 조직화되어야 하는지에 대한 4가지 기능을 제시한다. 첫째, 천법원은 천일국의 ‘법정신’으로서의 천지인참부모님에 대한 깊이 있는 연구 및 개발을 한다. 둘째, 천법원은 천일국의 ‘법원리’인 하늘부모님의 참사랑과 참부모 님의 말씀에 기초한 통일원리를 연구 및 개발한다. 셋째, 천법원은 천일국의 ‘법규 범’인 공생공영공의주의를 기본이념으로 하는 천일국헌법과 그 하위법들을 연구 및 개발한다. 넷째, 천법원은 천일국의 ‘올바른 법’의 표출인 천일국의 정착과 안착을 위한 비전과 전략을 연구하고 개발하는 기능을 천정원과 협업한다.
A Study on the Spirit of Laws and the Legal Application in Cheon Il Guk in the Perspectives of the Structure of the Original Image
In order for judges of the Cheon Beob Won, the judicial power of Cheon Il Guk, to adjudicate all disputes involving to interpret and apply the Constitution and laws of Cheon Il Guk, this research considers the legal hermeneutics of Arthur Kaufmann and discover its implications for finding ‘the spirit of laws’ of Cheon Il Guk, which is the criteria to interpret those laws of Cheon Il Guk. Based on these implications from Kaufmann's, by comparing ‘the spirit of laws’ of Cheon Il Guk to ‘the structure of the Original Image’ from the New Essentials of the Unification Thought, a principle for ‘the legal application’ in Cheon Il Guk is suggested. Judges of the Cheon Beob Won are expected to distinctly understand ‘the spirit of laws’ and ‘the legal application’ of Cheon Il Guk. Results from all legal disputes in Cheon Il Guk are expected to pursue to ‘balance and harmony’ instead of to ‘fight and division.’ Moreover, those results must contribute to the settlement and flourishment of Cheon Il Guk. Therefore, the Cheon Beob Won will play its best role by the following 4 researches. First, it researches on the True Parents of Heaven, Earth and Humankind as ‘the spirit of laws’ of Cheon Il Guk. Second, it researches on the Unification Principles based on the Heavenly Parent’s true love and True Parents’ words as ‘the legal principle’ of Cheon Il Guk. Third, it researches on the Constitution of Cheon Il Guk and its by-laws based on the principle of mutual existence, mutual prosperity and mutual righteousness as ‘the legal norms’ of Cheon Il Guk. Finally, it researches on the vision and strategies, as the expression of ‘the upright law,’ for the settlement and flourishment of Cheon Il Guk by collaborating with the Cheon Jeong Won, the executive power of Cheon Il Guk.
